INNOVATIONS IN PRESCHOOL EDUCATION: PROBLEMS AND PROSPECTS OF USE

Anotation. The definitive characteristics of such basic research concepts as innovations, innovations and innovative technologies are revealed. Domestic normative legal documents are analyzed, which reflect the issue of introduction of innovations in the educational process. Based on the development of psychological and pedagogical research, the concepts of innovation and innovation are distinguished. The elaborations of the issues of anti-innovation barriers are presented and their classification is given: external (social, organizational, methodical, material-technical) and internal (psychological). The concepts and genesis of SWOT-analysis technology are developed, on its basis the SWOT-matrix of use of innovative technologies in the educational process of preschool institution is created, in which the strengths, weaknesses, opportunities and threats of use of innovations in preschool are singled out. The problems of using innovative technologies in preschool are listed and analyzed, as well as the prospects of their use in preschool education are outlined.

METHODOLOGICAL FOUNDATIONS OF FORMING FUTURE MUSICAL ART MASTERS’ TRANSCULTURAL COMPETENCE IN THE PROCESS OF INSTRUMENTAL TRAINING

Anotation. In the provisions of the scientific article the author highlights the results of analysis of the current research of Ukrainian and Chinese scientists on the phenomenon of multicultural/intercultural/transcultural competence of the higher education applicants. The methodological foundations of forming transcultural competence of future musical art masters in the process of their instrumental training are substantiated. A number of general scientific and pedagogical approaches to the formation of this competence, in particular interdisciplinary, axiological, culturological and competence, which are specified in the relevant methodological principles, is characterized. The methodological principles of transcultural competence formation in future musical art masters are represented, in particular: the principle of unity of ethnic and universal values; principles of pluralism and tolerance in relation to musical cultures of different regions of the planet and their representatives and in the choice and interpretation of instrumental music, understanding of its value and originality; the principle of actualization of transcultural means of expression in the process of processing and arranging instrumental musical works.

THE STRUCTURE OF TEACHERS’ READINESS TO EXPLORE NOISE MUSICAL INSTRUMENTS IN EDUCATION PROCESS

Anotation. Based on the provisions of modern art pedagogy, musicology and psychology of musical activity, the author determines the structure of the future music teacher readiness to use noise musical instruments in the educational process. This readiness is interpreted as a special set of personal qualities. It is established that the composition of this readiness includes five components, namely: a) performing skills; b) knowledge of noise musical instruments and their application to musical-performing, compositional and pedagogical practice in different cultures; c) knowledge of different musical languages; d) ability to artistic and creative actions (arranging, improvisation, interpretation); e) psychological and pedagogical competence of the organizer and leader of music ensemble. On the basis of the constructed model some pedagogical methods of music teachers’ readiness formation are outlined.

SUBSTANTIATION OF THE STRUCTURAL MODEL OF TRAINING OF FUTURE SPECIALISTS IN THE ORGANIZATION OF YOUTH TOURISM

Anotation. The article highlights the results of an anonymous survey among internal and external stakeholders of the educational process in the tourism industry on the feasibility of training specialists in the organization of youth tourism in the Free Economic Zone. According to the results of the study, a structural model was created for the training of future specialists in the tourism industry to organize youth tourism. The structural pedagogical model consists of four blocks: the target block defines the purpose and tasks; organizational unit characterizes the methodological approaches, components, principles and organizational and pedagogical conditions; content-technological block determines the educational and methodological support of the educational process; the analytical-effective block has formed criteria and levels of knowledge, skills and abilities of future organizers of youth tourism. It is noted that the structural model created by us allows to qualitatively organize professional training of youth tourism specialists by increasing students’ motivation for future professional activity, introduction of integrated education, diversification of forms of practiceoriented activity and consolidation of professional experience in personal leisure activity.

MODELING THE PROCESS OF DEVELOPMENT OF CREATIVE POTENTIAL OF FUTURE MECHANICS IN AUTOMOBILE TRANSPORT COLLEGES

Anotation. Purposeful development of creative potential of future mechanics for maintenance and repair of vehicles and engines, modeling of this process for more detailed study of structural and functional features of the phenomenon is determined by the tasks of improving the quality of professional training in automobile transport colleges. The model of creative potential development consists of elements of the generalized character which in the independent kind can be considered as the subsystems integrating from separate components. The relationship between the components of the system and the integrity of the process of developing the creative potential of future mechanics for maintenance and repair of vehicles and engines is provided by relying on patterns, ideas and trends aimed at ensuring the integrity of generalized components. The model includes methodological-target, subjective, content-technological and diagnostic blocks. Realization of the purpose and tasks of development of creative potential of future automobile mechanics is carried out during three consecutive stages: organizational-diagnostic, technological and result-corrective.

Anotation. Author focused on the author's approach to determining the structural components of the readiness of the future physical education teacher to use innovative technologies in health activities. It is noted that the author used the following methods: analysis, synthesis, systematization of scientific works of other scientists in the context of certain issues. Motivationalaxiological, operational-cognitive, praxeological components are outlined. The characteristics of the content of each of the identified components of readiness are given. Emphasis is placed on the diversity of components, which is observed in the subject-subject interaction of the teacher and the recipients of educational services. Emphasis is placed on the expediency of further scientific work to present the developed model of diagnostic study of the components of readiness in order to form a complete picture of the readiness of future physical education teachers to use innovative technologies in health activities.

MODERN DESIGN EDUCATION: THE EXPERIENCE OF ASIAN COUNTRIES

Anotation. The article is devoted to the consideration and identification of the features of modern design education in Asian countries on the example of Singapore. It is emphasized that Singapore is one of the most developed countries in the world in the field of education, which is confirmed by the assessment of the International Center for Education Quality PISA: in 2018 Singapore ranked 2nd among 180 countries on three indicators (mathematics, science, reading). The modern education system of Singapore is described. The strategy for the development of Singapore until 2025, which contains recommendations for the development of design education, is considered. Defining skills of design students in the following areas are systematized: innovative business model, content development and strategy, creative entrepreneurship, sustainable development of design and ethics management, “responsive” design, interaction design practice, systems thinking, user interface design. The list of educational institutions that train designers for different sectors of the economy is presented.

CORRECTIVE AND DEVELOPMENTAL INFLUENCE ON THE AUDITORY DEVELOPMENT OF CHILDREN WITH COCHLEAR IMPLANTS

Anotation. In this article, we consider cochlear implantation as a complex method of influencing speech development from the medical, technical, social, economic, pedagogical points of view. Cochlear implantation is defined as a system of measures aimed at restoring auditory function, creating favorable conditions for speech, cognitive and social development on an auditory basis, which includes examination, surgery, as well as comprehensive pre- and postoperative support. Based on the analysis of the state and features of correctional and developmental impact on hearing development of children with cochlear implants in Ukraine and abroad, we outline main characteristics of the pedagogical component of support for children with cochlear implants and the conditions of its effectiveness. We have used theoretical and empirical methods: analysis of literature, observation, study and generalization of practical experience, surveys, and questionnaires.

ENCOURAGING PROSOCIAL BEHAVIOR OF PUPILS AS A STRATEGY FOR FORMATION OF SOCIALLY SUCCESSFUL PERSONALITY

Anotation. The article is dedicated to one of the urgent problems of modern psychological and pedagogical theory and educational practice – the formation of a socially successful personality of a pupil of general secondary education by means of strategic planning to stimulate prosocial behavior. The authors clarify the essence of the concepts «prosocial behavior», «strategy of formation of socially successful personality of a pupil» and focus on the essential characteristics of prosocial behavior and social success, their interdependence. It also substantiates the understanding of the strategy of forming a socially successful pupil's personality as a long-term consistent plan for the implementation of coordinated educational influences on the individual, which guarantees to achieve the expected results. It is emphasized that strategies of forming a socially successful personality of a pupil in the educational environment of a secondary school are implemented through the introduction of innovative methods and technologies that allow creating an environment of success in the institution, encouraging pupils to seek ways to their own success in indispensable link with public goods and gain individual experience of social success. The research presents the results of a set of different psychological and pedagogical methods, namely: theoretical (content analysis, comparison, generalization, reinterpretation) and empirical method (observation included).

Anotation. The article proves the importance of formation of methodical culture in future teachers of music art and the prospects of using the potential of personality-oriented didactics in this process. The distinctive features of personality-oriented didactics are identified and analyzed and the essence of phenomena (communication, pedagogical communication, interaction, pedagogical interaction) that determine its value essence and are the core for all its components is characterized. Anotation. The article analyzes the scientific work "Commonsense direct and digital marketing" by Drayton Bird. It has been found that the author singled out competencies that contribute to the formation of the competitiveness of a marketing specialist: diagnostic, analytical and prognostic competencies, social communication competence, modeling competence, design, forecasting, communicative and perceptual competence. It has been emphasized that productive means of skill formation can be project activities, problem solving, analysis of problem situations, implementation of various professionally – oriented elements of educational activity, as well as modeling of problematic economic, market – oriented situations. It has been concluded that the competency approach has significant potential and is a platform that can combine and comprehensively implement various developments in the field of active, developmental, activity learning.

PROFESSIONAL PICTURE OF COLLEGE STUDENTS – PROFESSIONAL SOCIALIZATION IN HUNGARIAN HIGHER EDUCATION IN TRANSCARPATHIA

Anotation. The planned research starts from the research experience of how the further education of college and university students develops depending on the following: what is the motivation of students for further learning, integration into the student society, the process of professional socialization in the institution, what is the professional picture during learning process and professional practice. The process of career orientation is also very important in Transcarpathia in terms of what kind of profession young people living in the minority choose, whether they are properly informed during the secondary school years, and whether they choose an adequate profession or profession in relation to their competencies and abilities. During the study period in higher education institutions, the professional socialization of students depends on the experience of the institution, the methods and attitudes of the lecturers, the student atmosphere, the college, university atmosphere, and relationship system, the prestige of the chosen profession and the level of higher education integration. The listed ones have an impact on the development of students’ professional image, possible drop-out (leaving a higher education institution, completion of studies without a degree), and the practice of a future profession. The fact that many studies have been made in Hungary and abroad makes the possibility of research actual. Numerous researchers have dealt with the topic, such as M. Anotation. The article considers the problems and prospects that arise in the introduction of distance education and e-learning in higher education in modern conditions. The concept of distance learning and providing this learning with appropriate educational materials, forms of interaction and organization of cognitive activity of participants in the distance educational process are specified. The main advantages and disadvantages of distance learning in the application of distance learning are noted. The differences between distance learning and traditional classical education are shown. It is concluded that distance learning can be an effective complement to the classic traditional forms of modern higher education, but should not replace them completely. Detected and analyzed a number of difficulties, characteristic of the implementation of distance learning, as well as proposed options for solving the problem.

The actualization of the semiological approach in the study of music in the last quarter of the 20th – early 21st centuries led to a shift in the research focus from such traditional issues for musicology as the form and content of a musical work, genre and style, towards the problems of text and text formation. The article offers an overview of some of the fundamental theoretical sections of musical textology, which at the present stage is becoming one of the most relevant disciplines in musicology. The main part of these problems is due to the lack of alignment and vagueness of its conceptual system. The article discusses the reasons for the current situation; the leading approaches are characterized, options for solutions are proposed, and related literary and musicological characteristics of the concepts of text, intertext and hypertext are given. Special attention is focused on the interaction of these key categories for musical textology.

INTERPRETATION AND PERFORMANCE DIMENSIONS OF “CLASSIC GUITAR” CREATIVITY

Anotation. The article considers interpretive and performing dimensions of creativity of the Mykolaiv collective “Classic Guitar”. The main stages of ensemble formation are presented. Emphasis is placed on the uniqueness of guitar groups in the artistic space of Ukraine. Participants of the Mykolaiv collective “Classic Guitar” choose a wide range of products. The programs of the band’s concerts, as a rule, are aimed at reproducing the musical style of a certain era and have a thematic unity. In particular, the ensemble’s repertoire includes violin and lute opuses of the Baroque period. Among them are a number of works written for lute or viola. In their activities, the band members combine different types of interpretation, not only purely performing, but also performing performing translations, which result in arrangements made by guitarists. Performing this part of the repertoire, the ensemble members have more freedom in the creative interpretation of musical material. As a result, they often use such colorful, specific guitar techniques as tapping (string hitting), golpe (hitting children), scratch on the string (a sound that mimics the mashing of a record by a DJ) and a number of others.

Anotation. The work defines the typological artistic and compositional characteristics of the design of national Azerbaijani “Kelagai” shawls, as well as reveals the possibilities of their role in the design of modern clothing. In carrying out research work modern scientific methods have been used: literary and analytical, historical and graphic, systemstructural analysis and methods of classification of compositional elements. In the course of research the peculiarities of construction of national headscarves “Kelagai” have been defined, the classification of coloristic range and ornamental elements has been carried out. On the basis of scientific research artistic means which were used at creation of artcompositional characteristics of national headscarves “Kelagai”, their use in shaping of a modern costume are defined. Suggestions for designing modern clothing with national and ethno-artistic elements were developed. For young designers interested in national art, the design of kelagai shawls filled with traditions may be useful. The given research topic can enrich designers with new information and lead to new ideas.

Anotation. The article analyzes specificity of development of domra school of Mykolaiv. The main stages of its formation, both implicit and explicit, are highlighted. The importance of the work of the Mykolayiv institutions of the Mykolaiv Music School, the Separate subdivision of the Mykolaiv branch of the Kyiv National University of Culture and Arts and the Mykolaiv College of Culture and Arts, in which the formation of the house performance of the region was carried out, is emphasized. The formation of domra performance was the result of intensive cultural and educational interaction with various regional schools and art centers of Ukraine. The influence of the leading domra regional schools – Kharkiv, Kyiv, Odessa, Donetsk on Mykolaiv ‑ was observed, which manifested itself in various aspects - exchange of methodological developments, creative interaction of artists, mastering of the newly created repertoire, etc. The leading feature of the Mykolaiv domra school is aspiration to creation of sound images which refer to traditions of baroque musicmaking. There is also a tendency to introduce an updated musical thesaurus, which is formed under the influence of avantgarde composition techniques, introduced by the works of modern composers.

Anotation. The paper deals with the evolution for motorized vehicle (MV) riders’ clothing. The influencing factors over the development process for drivers’ clothing and its improvement as a design-object were determined based on the previous studies. The sports style appearance prerequisite for MV riders’ clothing was considered and the development of its formation was researched. The manifestations of compositional expressiveness means were analysed due to the historiographical and visual-analytical methods based on illustrative materials. That made clear the diversification and enrichment of the riders’ clothing by various constructive functional elements, which not only provided the protective function, but formed compositional links as well inside and outside the uniform for the period of 1900-2020. The silhouette shape transformation analysis of sports MV riders’ clothing proved that their change was associated with the improvement of the garments aerodynamic and protective properties. The formation and improvement process analysis of the riders’ clothing as a design-object proved the dependence of technological progress factors on the peculiarities of sports motor racing disciplines. From all of the above it follows that the sports MV drivers’ clothing is a multifaceted phenomenon of design culture, which is in the continuous improvement process and requires an in-depth study.

MODERN INTERPRETATIONS OF CHAMBER AND VOCAL WORKS BY IVAN KARABYTS

Anotation. The article describes modern interpretations of chamber and vocal works by the outstanding Ukrainian composer Ivan Karabyts. The stylistic features of the composer’s chamber and vocal lyrics, which combine elements of Ukrainian folklore, classical romance and modern pop songs, are noted. The multicomponent style of chamber and vocal works by I. Karabyts is a consequence of ambivertism, which opens the possibility of their performance both on the academic stage and on the pop stage. With the help of musical analytical methods, synthesis and abstraction methods, a comparative analysis of classical and modern performing versions of vocal works “There are only cherries across the river”, “My land is my love”, “Our mother is a gray dove” was carried out. The analysis of I. Karabyts’s songs showed that the performer’s interpretation of ambivert works is variable and can focus on both academic (composercentric) practice and pop (performance-centric) practice. Among the modern pop interpretations of chamber and vocal and song works by I. Karabyts the most original are the performance versions of the famous singer Jamala, who thanks to the use of the jazz component created unique interpretations of his famous vocal compositions.

Also, the author proves that modern fashion presentations are able to create a certain virtualdigital matrix, which is associated with a significant transformation of the moral and value system “fashion – beauty – public person”. Included in the new information space of everyday use, beautiful body shapes and fashionable things become universal symbols of the exaggerated canon of modern beauty and presentable signs of success, prestige, which always go beyond the privacy and intimacy of a person in public communication. It is emphasized that the deterministic representation of the demanded open corporeality through intimacy and ugly beauty cannot be absolute. To some extent every person has its own existential, moral, spiritual needs that can influence the manifestations of narcissism, self-praise in a quasi-public environment and create the new cultural forms of communicative representativeness.

Anotation. The immanent feature of any fiction is its address to the reader. The dialogical nature of the reading process is realized in the context of cooperation between the reader and the author through the text. The course and parameters of this communicative process largely depend on the recipient as an active participant in the dialogue. Research on the perception of the literary work formed the basis of the theory of reader response and the theory of receptive aesthetics, which became especially popular in Western literary criticism in the middle of the last century. The article is devoted to the social approach to interpretations of the reading process, which covers many aspects of the socially constructed identity categories including race, class and gender. The crucial feature of the reader social-constructivist theories is consideration of the specific social context in study of the peculiarities of the fiction perception. The particular area in social theories of the reader is feminist criticism, whose representatives verbalized the distinctive importance of the gender for the process of perception in the literary fiction.

THE NOTION OF “MANIPULATION” IN POLITICAL DISCOURSE

Anotation. The article is consecrated to understanding the concept of "manipulation" in political discourse. Manipulation is considered quite traditionally – as a type of psychological influence, characterized by the installation on the hidden introduction into the psyche of the object of goals, desires, intentions, do not coincide with those that the recipient could formulate independently. Manipulative influence in discourse is due to its cognitive nature, is projected on the basic opposition of "their" – "foreign" and is realized through the specific functioning of linguistic means of lexical, morphological and syntactic levels. Speech influence can be considered from a dynamic (impact) and from a static (perlocutionary effect) positions. In a broad sense, we can talk about language influences in various types of discourse (advertising, science, politics), as well as in terms of achieving various operational goals – misleading, refuting the enemy, self-presentation. Influence in terms of awareness of the recipient, but with opposition to it (rhetoric communication with opponents, where reflections on the content of the discourse by the latter are natural and relate to both the propositional content of the message and the use of manipulative techniques).

TACTICS OF INTIMACY OF COMMUNICATION IN THE SPEECH OF DONALD TRUMP AND JOE BIDEN

Anotation. This article examines such a linguistic phenomenon as the intimacy and use of it by Donald Trump and Joe Biden in their communication with the people. This tactic is designed to reduce the tension between the speaker and the audience, which will help them establish a friendly relationship between them. An important factor is the selection of an audience with those beliefs that are close to the speaker. The next step is to convince people of their rightness and push them to appropriate action, to evoke the necessary emotions and feelings. To do this, they use various stylistic figures of speech (antithesis, rhetorical questions, metaphors, etc.). Based on the research, we give examples and prove that their speech is not always objective and supported by facts. This is the main feature of political discourse.

MOTIVE AS AN ELEMENT OF THE NARRATIVE STRATEGY PROSE OF PANAIT ISTARTI AND VLADIMIR KOROLENKO

Anotation. The article examines the category of motive as an element of the prose narrative strategy of the Russian and Romanian writers V. Korolenko and P. Istrati in a comparative aspect. Narrative analysis is used as a method for narrative strategy studying, a way of narrative ordering in the sequence of the events series. The comparative typological (comparable) approach is used to study the narrative through the motives comparison of narrative creativity since the communicative plot whole consists of plot statements built on the basis of plot events determined by motives. Typological parallels in the writers’ prose motivational analysis can be traced at the interconnected motives level typical of their work: roads, meetings, freedoms, vagrancy. They perform structure-forming and plot-forming functions determining the genre content of works. The conducted motivational analysis made it possible to investigate the typology of these writers' fictional prose in terms of formal and substantive features, and determined their role in the prose narrative system. The problem of studying narrative strategies in literary science has acquired a qualitatively new character which requires additional theoretical and historical-literary comprehension and further research.

Anotation. The article is devoted to the research of Information Security System of modern Ukrainian society on its way from establishment to meeting global requirements. Within the systemic theoretical analysis approaches to the goals, tasks and key elements of providing the adequate security support are defined. It is also depicted that the concept of “information security” and “national security” are inseparable. The state’s attempts to comply with the global security standards have been steadily increasing since the early age of a newly independence until current time, and yet show the determination to meet the demands of the world key leaders. The criteria of society’s entry into global information community are analyzed on the legislative and regulatory levels. It shows that the goals of the security system include protection in various sphere of human activities from political and international sphere to private consumption of information products. The paper represents the results of the analysis of potential threats and their consequences for the society. Particular attention is paid to the criteria to meet by Ukrainian responsible agencies in terms of information security interaction with the European Union and NATO. It is determined that the EU and NATO memberships are on the priority list for today.
Keywords: The article is devoted to the research of Information Security System of modern Ukrainian society on its way from establishment to meeting global requirements. Within the systemic theoretical analysis approaches to the goals, tasks and key elements of providing the adequate security support are defined. It is also depicted that the concept of “information security” and “national security” are inseparable. The state’s attempts to comply with the global security standards have been steadily increasing since the early age of a newly independence until current time, and yet show the determination to meet the demands of the world key leaders. The criteria of society’s entry into global information community are analyzed on the legislative and regulatory levels. It shows that the goals of the security system include protection in various sphere of human activities from political and international sphere to private consumption of information products. The paper represents the results of the analysis of potential threats and their consequences for the society. FORMATION OF PSYCHOLOGICAL COMPETENCE OF NURSES OF PRESCHOOL EDUCATIONAL INSTITUTIONS TAKING INTO ACCOUNT THE KNOWLEDGE OF GENERAL AND MEDICAL PSYCHOLOGY

Anotation. The article analyzes the specifics of the professional ACTIVITY of nurses of preschool educational institutions. In preschools, nurses pay the most attention to maintaining and promoting health. However, they were NOT targeted for work in preschool educational institutions. And work with preschool children requires consideration of psychological features not only of pupils. While studying at the medical college, the course “Fundamentals of General and Medical Psychology” is taught. We analyzed the Program. Gaps in knowledge, lack of skills in solving psychological issues (in communication, finding ways out of conflict situations, establishing interaction with students and their parents) were the reason for choosing a topic. Theoretical and empirical research methods were used. determination of levels of development of mental properties of nurses of preschool educational institutions according to the Psychogram of the nurse IS Vitenko. SOCIO-POLITICAL CLEAVAGES IN LOCAL ELECTIONS

Anotation. The article is devoted to the factors of differentiation of electoral preferences of citizens in local elections. Analyzing the results of polls and election statistics, the author concludes that there are four types of socio-political distinctions – socio-professional, socio-class, settlement and spatial. These divisions are determined by national political processes and delineate the boundaries of the target audiences of different constituencies. The article identifies empirical indicators for verification of the sociological approach – socio-professional category ( “white” and “blue” cells) or employment group (employed and unemployed), type of settlement (large, small towns, villages and hamlets), localization in regional political space (center, semi-periphery and periphery). The author proves that the electoral behavior of representatives of different social groups is transformed from election to election, in particular, the biggest differences are observed between the working and non-working population. Settlement and spatial divisions are associated with the diversity of regional politics, opportunities for free electoral communication, and the presence of powerful local financial and industrial groups. The classic “cleavages” became clear in the fall of 2020 – the poorest part of the population actively supported the OPZZh, and the self-identified middle class voted for the "Servants of the People".

Anotation. The article is devoted to the analysis and substantiation of the program of psychological work with gender-role conflicts in women of reproductive age. The article considers the theoretical basis and guidelines for the development and implementation of this training program. The developed training is designed for 30 hours and is aimed at expanding knowledge about gender identity and self-image in the life of a modern woman, increasing reflection on one's own gender self-image; developing skills in defining gender roles and related stereotypes, reflection on one's own roles and stereotypes, role load and role balance; development of skills to recognize gender-role disharmonies and conflicts and skills of their prevention and overcoming. The article contains the content of the training program and the results of its testing, which proved the effectiveness of its use.

Anotation. The problems of interactive monitoring and diagnostics of the condition of highways are considered. Methods of assessing and diagnosing their operational condition are part of the general and special information support, which is part of the information infrastructure of the transport complex. Improving traffic safety, speed, comfort and efficiency of passenger and freight transport by road, improving the transport and operational condition of roads, bridges, ensuring the systematic development of the road network depends on sufficient awareness of road users. Therefore, improving technical performance, increasing the competitiveness of roads, promoting socio-economic and environmentally sustainable development of the transport complex is associated with effective monitoring of roads, which should be the main source of reliable information about the state of roads at local, regional and national levels.

Anotation. The article is devoted to clarifying the nature and features of the procedures for resolving customs disputes in the administrative order. It is established that the resolution of customs disputes is administratively regulated by the Customs Code of Ukraine, the Law of Ukraine “On Citizens’ Appeals”, the Tax Code of Ukraine and the relevant orders of the Ministry of Finance of Ukraine. The peculiarities of the procedures for resolving customs disputes in the administrative order are described. It is emphasized that the procedures for resolving customs disputes in an administrative manner are regulated by customs, administrative and tax legislation. Procedures for resolving customs disputes in the administrative order are distinguished, which include the following: the procedure for appealing decisions of customs authorities, the procedure for appealing which is determined by the Customs Code of Ukraine; procedure for appealing against decisions of customs authorities in the field of taxation; procedure for appealing actions or omissions of customs authorities; the procedure for processing appeals received by customs authorities from the state institution “Government Contact Center”. SYSTEM OF NORMATIVE LEGAL ACTS ON THE SOCIAL PROTECTION OF LAW ENFORCEMENT OFFICERS

The article considers issues related to normative legal acts, among which are the Constitution of Ukraine, constitutional laws, decrees of the President of Ukraine, resolutions, normative acts of executive authorities. In addition, laws and other regulatory legal acts that are adopted by public authorities. The sources of law as international acts, international treaties of Ukraine are also considered. Researched and analyzed the work of scientists on this issue. The issues of social protection of law enforcement officers, which is carried out using the same sources of law, and social protection of the population and social protection of civil servants are also considered. The author, when analyzing the material on the “System of normative legal acts on the social protection of law enforcement officers”, concluded that international treaties and agreements of Ukraine with foreign states are also legal sources of social protection for law enforcement officers. Further research of the sources of law on social guarantees for law enforcement officers should be carried out on the basis of social protection measures. A specific legal source of social protection for law enforcement officers is judicial practice. In this case, we are talking about courts of general jurisdiction, the Constitutional Court. Courts of general jurisdiction have a positive impact on lawmaking and law enforcement in the field of social protection of law enforcement officers.

It is pointed out, that the person’s activities that engages in professionally, may correspond to the risks of victimization. The victim’s professional affiliation can become the main reason for committing a number of criminal offenses against her. Based on the results of the empirical research, socio-demographic, criminal-legal, socio-role and moral-psychological characteristics have been analyzed. A generalized portrait of a subject of professional victimization is proposed. Such subject can be described as a man aged 20 to 40, with higher education, married, usually a law enforcement officer, characterized by a neutral attitude to the offender, with whom before a crime has been committed, he had a contact in connection with the performance of his professional duties. Possibilities of classification of subjects of professional victimization (according to the criteria of publicity of the profession and the presence of professional risk) have been analyzed.

АPPROXIMATION OF THE NATIONAL PRACTICE OF EMPLOYMENT OF CONVICTS TO EUROPEAN STANDARDS

Anotation. The article is devoted to the issues of inconsistency of Ukrainian practice of employment of convicts with international standards. It is confirmed, that nowadays the penitentiary policy of Ukraine isn’t totally aimed at supporting the convicts’ professional skills and even more their developing. That’s why the prospects of employment of convicted persons after release are quite disappointing. Therefore, a qualitative reform of this area is needed. Based on the analyzed materials, the author concluded, that solution of the problem of employment is needed a comprehensive approach. Threefold model was proposed: changing the mechanisms of assistance in employment of convicts – changing society’s attitude to convicts – improving coordination and cooperation between participating bodies and institutions during preparing convicts for release.

REASONABLE TIME OF A TRIAL IN SMALL CLAIMS

Anotation. The article is devoted to the study of the features of the implementation of the convention guarantee of reasonable time of a trial in small claims. A detailed description of the criteria developed by the ECtHR practice, according to which specific procedural deadlines can be assessed as reasonable, is provided. The criteria of temporal reasonableness are divided according to the functional-target feature, where the first group covers the parameters for assessing the behavioral reactions of participants in the trial, while the second group of criteria concerns the legal qualification of the dispute and its significance for the parties (the applicant). The concept of judicial time management is defined as the organizational activity of the court to regulate the temporal dynamics of the development of the process through the use of the latest methods of planning its course. It is established that the effectiveness of judicial time management is objectified through the prism of temporal rationalism, which manifests itself in a proportional relationship between the permissible-expected and actual duration of consideration of the case by the court. The degree of rationality is determined by evaluating the limits of the duration of proceedings in a case for their relevance to the parameters of a certain content, namely, the optimality and predictability of the terms of the trial. For the purposes of temporal optimization of the procedure for judicial consideration of small claims, innovations of the corresponding content and direction are proposed.

TRANSFORMING THE IDEA OF EQUALITY: MORAL VALUE OR HUMAN RIGHTS

Anotation. This article describes and analyzes the main point of egalitarian conception – equal treatment in the sense of an equal distribution of collective resources. For a better understanding of the nature of fundamental ethical equality, it is necessary to choose the idea of formal equality, which is a key in socio-political egalitarian concepts. We have to cope with the fact that equality is not a collective good to which one can have a right, it is not possible to say, that all individuals have a right to equality. It is rather a social ideal, a vision of how society as a whole should be organized on the right to live in a society in which resources are equally distributed. It considers closely arguments made by Ronald Dworkin that equality should be a value in law or political theory. In moral and ethical terms, equality is a normative requirement of equivalent mutual exchange of diverse values, while legal equality provides for a single space of social freedom. Social ideal of equality has founded expression in the law in two ways in the principle of equal treatment and in the principle of non-discrimination. Now, the right to equality means not only the right to equal protection by the law, but also the equality must be understood as the equal distribution of resources.

In the article "Transfer of civil service to local self-government" the author analyzed the scientific work of scientists, as well as the regulatory framework for the stability of labor law relations, as one of the basic principles of labor law. It will be investigated the legal regulation of the transfer to another job in general, as well as the transfer of civil servants to local governments. Also, the author has analyzed the work function as lawyers often do not distinguish its legal features, designating it as work for a certain profession, speciality or position, pointing out its link to production, scientific and technological progress, disassociating the work function from the corresponding legal duties of the employee. In the present conditions of the state management the exclusion of references to occupation, profession, qualification or position from the legal definition of labor functions is caused by the new market realities of labor force use.

The role of Ukrainian presidents in ensuring effective results of state transformation is freed, the need for reform transformations with the involvement of international experience to change the legal status of this institution in solving strategic problems related to Ukraine’s sovereignty is substantiated. The pragmatic expediency and necessity of in-depth and thorough study of the international experience of the legitimacy presidents of USА are substantiated.

In the article the author reveals the essence of the adversarial nature of the parties as a principle of criminal proceedings and its invocation in the exercise of procedural rights by the prosecution and the defense while investigating of tax crimes. Also the author has analyzed approaches to assessing the reasonable term of the pre-trial investigation, which was done with taking into account the latest changes in legislation. Amendmends to the Criminal Procedure Code of Ukraine, which will eliminate the abuse of procedural rights and ensure the balance of interests of the parties to the criminal proceedings are proposed.

FREEDOM OF RELIGION AS A DIRECT OBJECT OF A CRIMINAL OFFENSE: PROBLEMS OF DEFINITION

Anotation. The article is devoted to the study of criminal offenses committed based on religious hatred and the object of which is freedom of religion. It is stated that in legal use there are two terms that can act as public relations that constitute the object of criminal law protection in criminal offenses related to the realization of a person’s religious needs (religiously motivated) – these are “freedom of conscience (worldview)” and “freedom religion”. It is concluded that freedom of religion in the criminal-legal sense is a legislative guaranteed right of an individual freely, without external coercion, to choose, profess any religion, freely change his religious preferences, satisfy his religious needs, and carry out other cult actions in accordance with his religious orientation. Freedom of religion gives the right not only to choose any religion, but also not to choose any. That is, the right to choose also presupposes the right to refuse a choice. Obstruction of the implementation of the above needs, including those that are religiously motivated, and constitute the essence of the public danger of such a criminal offense as that provided for by Article 161 of the Criminal Code of Ukraine.

HUMAN RIGHTS AND FREEDOMS IN OPERATIVE SEARCH AND COUNTERINTELLIGENS ACTIVITIES: THEORETICAL PROBLEMS (BY UKRAINIAN LEGISLATION)

Anotation. The article is devoted to the research of theoretical problems of legal guarantees of observance of human rights and freedoms in operative search and counterintelligence activities based on the principle of mutual responsibility of the state and the person. As a result of the research, it was found that the current state of guaranteeing human rights and freedoms in operative search and counterintelligence activities generally meets international standards, the requirements of the Constitution and other sectoral laws of Ukraine. The system of such guarantees is a set of legislative provisions aimed at: creation of conditions necessary for observance of the rights and freedoms of the person involved in the sphere of operative search or counterintelligence activities; the possibility of temporary restriction of certain human rights and freedoms exclusively by authorized entities, if there are appropriate grounds and due process of provided by law; restoration of violated rights and compensation for damage caused to a person as a result of violation of his rights and freedoms. Some shortcomings in the field of guaranteeing human rights and freedoms in operative search and counterintelligence activities have been identified and suggestions were made on ways to eliminate them.
