Anotation. This article discusses the concept of general cultural literacy and analyzes the formation of general cultural of future primary school teachers by means of fine and musical arts. The basic principles of art pedagogics are determined and the expediency of using integration is substantiated. The directions of using the cultural potential of disciplines during classroom and extracurricular educational activities are offered, which will promote the development of future teachers’ aesthetic needs

COMMUNICATIVE ACCESSIBILITY OF THE EDUCATIONAL PROCESS FOR DEAF AND HARD-OF-HEARING SIGNERS

Anotation. This article highlights the status of sign language in different time periods of the formation of the Ukrainian state. Attention is focused on the correctness of the use of certain terms (“deaf”, “hearing impaired”), and internationally recognized terms (“deaf”, “semi-deaf”) are proposed. The classification of certain persons as deaf and semi-deaf is explained. Due to the spread of inclusive education in Ukraine, attention is focused on the dangers that inclusive education can pose in case of violation of certain conditions. At the same time, the conditions for high-quality coverage of deaf and semi-deaf persons with inclusive education, which are practically absent in Ukraine, are listed. The general rules of communication between a teacher and his assistant with a deaf applicant who studies in an inclusive classroom are revealed. The role of a communication assistant and the forms of communicative assistance that he should have is highlighted.

Anotation. In the provisions of the scientific article, the authors consider the problem of the formation of the management culture of future teachers. The authors analyzed the components of the management culture of the students; the potential opportunities of interactive learning technologies in higher educational institutions in the context of the formation of the management culture of the educational management specialists; the levels of the formation of the management culture of masters of specialty 011 – Educational, pedagogical sciences have been investigated; the program for the formation of management culture of students of specialty 011 – Educational, pedagogical sciences has been developed.

THE USE OF INNOVATIVE TECHNOLOGIES TO INCREASE ENGLISH-LANGUAGE COMPETENCE IN READING IN GENERAL SECONDARY EDUCATION INSTITUTIONS: METHODOLOGICAL ASPECT

Anotation. The article considers the methodology of using innovative technologies, Internet resources, software applications that help to implement and increase English-language competence in reading in general secondary education. It is proved that in English lessons with the help of innovative technologies it is possible to solve a number of didactic tasks: to form reading skills and abilities, using materials of the global network; replenish students’ vocabulary; to form students’ motivation to read in English. In particular, the importance of a systematic choice of teaching aids to achieve specific goals set by the teacher is shown. The main IT, computer applications and various Internet platforms that contribute to the evolutionary processes in the education system and contribute to the formation of English language competence of students are analyzed. Classifications of types of reading based on various criteria are given.

Anotation. The article is devoted to the study and analysis of the development of the system of foreign students’ pre-university training at Ukrainian institutions of higher education. The development of the studied phenomenon is actualized in the periodization which covers the gradual periods: the system of foreign students’ pre-university training at Ukrainian institutions of higher education of Soviet times and the times of Ukrainian independence. The characteristics of determined periods of the system of foreign students’ pre-university training at Ukrainian institutions of higher education development are presented. Based on the analysis of interpretive sources and regulatory framework, the general development movement of the system of foreign students’ pre-university training in the specified period is traced, positive and contradictory tendencies of changes are singled out.

THE METHODOLOGY OF WORKING WITH PROPER NAME AS DYNAMIC IMAGE-CHARACTERS STUDY REGULATOR

Anotation. Some characters of literary work are dynamic formations. Their dynamics manifests itself in the change of appearance, status role or internal changes (character, values, preferences, life goals). In a number of works this dynamics is emphasized not only by the depicted events or the character’s behavior but also by using proper names – the names of literary heroes. The problem of working with proper names as a dynamic image-characters study regulator is not developed in the methodology of teaching Ukrainian literature. The article proposed the optimal approach to the characterizing of the heroes of dynamic type within image-by-image analysis which is the most productive in this regard and acquires a special invariant. The basic requirements to the theme and purpose of the lessons devoted to the analysis of the corresponding characters and their names are formed. The algorithm of constructing educational situations and micro-situations which content is determined by a certain aspect in the heroes’ life and their own names is outlined.

PRINCIPLES OF DEVELOPING THE QUALIFICATION OF CIVIL SECURITY SPECIALISTS TAKING INTO ACCOUNT MODERN APPROACHES TO PROFESSIONAL ACTIVITY

Anotation. In the article, as a result of theoretical and methodological analysis, the principles of professional development of specialists in civil security are identified. They are divided into two main groups: general principles and sectoral ones. Each group of principles of advanced training of civil protection specialists is analyzed with taking into account the peculiarities of professional activity. The general principles of advanced training of civil security specialists include the principles of continuity, obligation, variability, innovation and self-actualization. The sectoral principles of advanced training of civil security specialists include the principles of: balance, individualization, combination of training with practical activities, similarity to the real conditions of professional activity and readiness to act in situation of increased danger. These principles are closely interrelated, interdependent and producing each other, create conditions for a deep understanding of the essence of the studied process of civil security specialists’ professional development. In scientific discourse, the essence of the phenomenon of “the principle of advanced training of civil security specialists” as a basic position or basis that determines the requirements for the components of the methodological system of professional development of civil security professionals is defined.

TEACHING LISTENING COMPREHENSION AT HIGHER EDUCATIONAL INSTITUTIONS

Anotation. The article deals with teaching listening comprehension at higher educational institutions. The author describes the stages of teaching listening and provides different tasks for listening activities. The main criteria for selecting listening materials for teaching listening comprehension at higher educations are described. The paper highlights the importance of listening material in teaching listening. Particular attention is paid to the advantages and disadvantages of using video materials in teaching listening skills. The author emphasizes that using internet resources for teaching listening skills makes lessons more efficient and increases students’ motivation. Typical difficulties of listening comprehension of professional-oriented text are characterized. The author recommends taking into consideration these difficulties while developing exercises for teaching listening professional-oriented texts at higher educational institutions.

THE IMPLEMENTATION OF SPATIAL-TEMPORAL MOTIVES IN JACK LONDON’S COLLECTION “STORIES OF THE NORTH”

Anotation. Describing pictures of the North, Jack London uses numerous motives, including spatial-temporal ones, such as the motif of road, nature, meeting and separation. The article gives examples of implementation of the given motives on the example of Jack London’s “Stories of the North”. In American literature, the motif of the road occupies an important place, because America began with a great journey, with the development of the unknown. The stern heroes of Jack London have a spirit of adventure. In the work of this writer you can see a purely American point of view on the motif of the road. Jack London’s characters have a movement towards the “American dream”. The motif of nature is one of the key in Jack London’s “Stories of the North”, the author pays great attention to the description of weather, trees, animals, ponds, which creates a special atmosphere of the works.

ALEXANDER ARCHIPENKO’S HERITAGE: THE SHAPE-FORMING DOCTRINE

Anotation. The main features of Alexander Archipenko’s (1887−1964) shape-forming doctrine were examined in the article. The sculptor dynamically developed the plastic arts, introducing new concepts and methods, the combination of different materials, kinesis, and the synergy of space with the metaphysical representation of the shape. The artist’s ideas and thoughts of his biographical periods were examined. The bases of the sculptor’s aesthetic views were explored. The main influencing factors on the formation of Archipenko’s plastic arts conception were identified. The sculptor’s philosophical line was designed through the multicultural anthropological dimension of the ancient peoples of the world. Archipenko’s art heritage can be a valuable resource for the artistic seeking of contemporary concepts.

STREET ART TYPOGRAPHY: SOCIAL AND CIVIC ASPECT OF INTERACTIVE COMMUNICATION

Anotation. The purpose of scientific work is to continue research of the interactive tools of street art typography in the period of the second decade of the 21st century and to establish the impact of typography on the process of visual communication in modern cities in terms of socio-civic character. In this work, we used the system-information and the visual-analytical methods for the analysis of interactive aspects of visual communication in the modern urban system. In the process of scientific work, we implemented an analysis of social street art projects, which complemented the already identified at the previous stage of the study areas of effective implementation of typography in the visual space of cities. The scientific novelty lies in the definition of visual techniques of street art typography used by creators in social projects by initiating situations with different models of interactive communication in the urban information space.

SOME ASPECTS OF THEATRICAL REFORM: CONSEQUENCES, PROBLEMS, PROSPECTS

Anotation. The article considers the peculiarities of reformatting the theatrical process in Ukraine. In the course of the analysis the reasons for the slow implementation of reforms are considered, the conclusion about the functioning of the outdated model of stationary theaters, which does not correspond to the realities of modern life, is made. Priorities in the construction of a new theatrical paradigm based on European cultural values and national mentality are identified, arguments are presented for the need to eradicate imperial approaches to language policy. A number of topical issues related to the policy of decentralization were considered, the results of reforms at the grassroots level, overcoming challenges related to illegal blocking of new theatrical initiatives, lack of proper support for non-state theater groups were considered. An attempt is made to outline the current problems of the stage embodiment of modern Ukrainian drama, the arguments of the need to rethink and introduce into theatrical and pedagogical practice of the theoretical heritage of the outstanding Ukrainian director Lesya Kurbas.

ZASADY PODNOSZENIA V. PRYKHODKO’S THEMATIC CANVASES AND FOLK-MODERNIST RETROSPECTIONS IN THRANSCARPATHIA PAINTINGS AT THE SECOND HALF OF THE 20TH AND THE BEGINNING OF THE 21ST CENTURIES

Anotation. The study characterizes image-thematic specific features of thematic canvases V. Prykhodko in the context of folk-modernist retrospections in Ukrainian paintings at the second half of the 20th and the beginning of the 21st centuries. It has been used semiotic, formal-stylistic methods of analysis to achieve the aim of the study. The author reveals that the period of artist’s creative development characterizes with the integration of folk and art expressive means, influence of formative principles of monumental paintings. Among mature creative works the author outlines canvases where the front sledges are depicted in one- or several-figured compositions with abstract background; works where philosophical contents are presented with the relations of nature states and individual, custom-trivial and ritual life; woman’s images based on the depiction of world presented with symbol-spacious elements of the cross, archways, windows, folk iconography, updating of the myth-poetical complex symbolism of a garden as a paradise. The author analyzes canvases of religious themes based and applies for means of folklore, folk iconography, sacral carving.

Anotation. The paper considers architectural graphics as a work of art. Today, under the influence of globalization processes and the active development of computer graphics, the form of manual delivery of projects is almost not used, and digital technologies are preferred. Therefore, the problem of preserving such monuments of architectural graphics as an important historical source and artistic heritage is urgent. A graphic design of a paper-based railway station in Kyiv in the 1920s and 1930s, designed by architects Pavlo Alyoshyn and Oleksandr Verbytsky, was chosen for the study. A detailed analysis of the initial preservation state of the work and restoration and conservation measures applied to it was carried out. A study was conducted on the history of the project, systematisation of the types of damage characteristic of this type of work, in order to use this information to optimise preservation approaches for the architectural graphics projects. This work is considered as an important example for the preservation and restoration of large-format works of architectural graphics, similar to those stored in reserves, libraries and archives, waiting for the much-needed restoration activities.

PUBLICITY IN HISTORICAL FACTS OF CULTURE AND PHILOSOPHICAL REFLECTIONS

Anotation. The article conceptually presents the historical and cultural vector of the formation of the phenomenon of publicity. In particular, the author reveals the main historical origins of this phenomenon and its manifestation in the cultural and communicative space of a certain epoch. It is proved that the historical approach represents publicity as an independent subject of scientific and theoretical research within anthropological philosophy from the existing manifestations of а human being, because in the meaning of the term “publicity” a person is already contextually present in their complicity and active actions. At the same time, each historical epoch had its ideas about the phenomenon of publicity, which depended on certain social, cultural, political conditions that dominated at certain times. The values and principles of secular publicity coincide and change together with the transformation and understanding of human public nature, its place in the communicative field of modernist and postmodern culture.

ANTIQUE FEMALE MASKS IN UKRAINIAN LITERARY MODERNIST PROJECT

Anotation. The relevance of the study is due to the constant interest in mythologizing and the author’s variants of its manifestation. The research applies different methods of research; suggests a typology of antique female images, and determines the ones to most often became an object of artistic understanding in Ukrainian modern poetry. There are various interpretive strategies: neoclassical poets give preference to images that convey the idea of kalokagatia, the search for balance between personal and social, the dominance of art over politics. The symbolist Tychyna appeals to ancient mythology to comprehend the socio-political situation in Ukraine and the dramatic aspects of the totalitarianism ideology. Whereas Mosendz, Yurii Klen and Malaniuk interprets the female images, as they embody the motives of freedom and struggle for independence. Thus, their poetry reveals a mode of mythologizing, the author’s myth-making, aimed at re-reading the traditional content to express culturological, ontological, and aesthetic contexts.

TEXT CATEGORIES IN THE POETRY OF VOLODYMYR KACHKAN

Anotation. In the article the author for the first time described the linguistic means of realization of textual categories of coherence and intertextuality in the poetry of the Ukrainian poet and prose writer Volodymyr Kachkan. The source base of this article is constituted of the poetic verbal goals (more than 150 texts), from which a selection of lexical and grammatical units which manifest text categories was made in the way of accurate and complete inventory. The research method is descriptive. The author found that the figurative-associative, semantic, word-forming, grammatical, etc. textual category of coherence and intertextuality acquired a special expression. Intertext is introduced into the poetic verbal goals of Volodymyr Kachkan by a number of techniques: allusion, reminiscence, quotation, etc., and is treated as an intratextual phenomenon. The main ways of implementing the category of intertextuality in the poetry of the researched author are allusions (biblical, mythological, folklore, vocations to famous people or to famous events, allusions in parodies of literary texts); quotes; reminiscences. The prospect of further research is to study the textual categories of the writer in prose texts.

VERBALIZATION OF SYMBOLS OF THE RUSSIAN-UKRAINIAN ARMED CONFLICT (MODELLING OF THE ASSOCIATIVE-SEMANTIC FIELD)

The paper presents a fragment of the modelled structure of the associative-semantic field “WAR”. 176 constituents, grouped into associative-semantic groups “volunteers” and “symbols” within the associative-semantic microfield “DEFENDER” are analyzed. The research material (words and combinations used to verbalize the symbols of the Russian-Ukrainian armed conflict in the period from 2014 to the first half of 2021) is selected from the texts of information resources, statements of Ukrainian officials / politicians, as well as posts and comments on Facebook. The method of modelling of the associativesemantic field as the main one is applied. Within the ASG “volunteers” (114 constituents) there are two associative-semantic microgroups – “volunteers” and “actions”. ASmG “volunteers” is represented by words and combinations used in the information field to denote those who help the army. ASmG “action” is manifested by compounds with positive semantics to denote volunteer activity. Within ASG “symbols” six ASmG (62 constituents) are allocated, for designation of the events, the phenomena which had a public resonance and were fixed in a language lexicon at the level of concepts-symbols: “heroism / perseverance”, “international relations”, “metaphors”, “truce”, “ironic winged phrases”.

ONYMS AS MEANS FOR ACTUALIZATION OF SUBCONSCIOUS STRUCTURES IN THE POETIC LEXICON OF LESIA UKRAINKA

Anotation. In this article for the first time onyms were subjects to study as psychological element of language personality of Lesia Ukrainka what for material of her poetic creativity was drawn upon. The selected material was traced through by applying descriptive, contextual – interpretation narrative methods what was supplemented by involving analysis of psychological resources. The eventful facts of the biography of the poetess were outlined and key contexts of her artistic language studied what highlighted the specifics of isteriod accentuаtion of Lesia Ukrainka. Analysis was done of use of real and fictional onyms in the titles, dedications and, in particular, text space of the poetess. The psychological information may be conveyed inherently – by the form of onyms on its own and adherently – by lexicological surrounding. It is proved that proper names in conjunction with other language means textualize traits of covered hystericus, becoming correlations of impulsivity, communicability and theatricality, creative productivity, linquocreativity, valuable priorities, and intellectual power. So far, we may conclude that identification of psycho accentuation with reference to impact on the fiction language is the relevant psycholinquistical component for perception of the style of the language personality what requires further investigation of this subject.

Anotation. In the article the structure of fictional world is analyzed in the light of the cogtitive anthropology. Cognitive anthropology is an approach of text analysis that combines cognitive methodology and literary anthropology. Fictional worlds theory defines the fiction as a text formed between the experience of the author and the experience of the reader. In this research the fictional world is divided into text world and discourse world. Text world consists of the character world and the real fiction world. Сharacter world is divided into knowledge world, wish world, obligation world, intend world, fantasy world. Discourse world is created during the communicative act between the author and the reader. In the article modeling of the discourse world of Uriz text H. Pahutiak in the light of the fictional worlds theory and the text worlds theory is devised. The author uses remarks to make the reader understands the meaning of the images.

BECOMING THE SUBJECT OF LEISURE ACTIVITY AS PART OF PERSONAL BECOMING

Anotation. Consideration of the problem of personality formation is based on the methodological opposition of the concepts of formation and development in the context of systematically implemented influences of a social institution. The concept of development is associated with changes with participants in social relations in the process of their interactions. This interpretation of the problems of training cadets of a higher military educational institution allows us to determine the psychological mechanisms of their personality formation. The main thesis of the article is a statement about the conceptual identity of the cadet’s professional training program and the program for organizing his leisure time. It is noted that the formative continuum of activity of a higher military educational institution and the continuous process of personal development form a holistic educational process based on individual mental characteristics and preferences of cadets. The creation of such a formative continuum should be based on a system of means aimed at creating a holistic empirical basis in the form of participation of cadets in collective leisure activities with an appropriate emotional atmosphere.

FACTORS AND BARRIERS OF SOCIAL ADAPTATION OF INTERNALLY DISPLACED PERSONS

Anotation. The article attempts to identify factors and barriers to the social adaptation of internally displaced persons. It is established that under the current conditions the concentration of refugees and internally displaced persons is differentiated on the territory of Ukraine, so the problem of their social adaptation is relevant for all regions of the country and the whole Ukrainian society. Social adaptation of internally displaced persons to new living conditions is accompanied by a number of barriers, including: lack of experience in state regulation of migration flows in conditions of involuntary displacement; low level of quality of migration statistics data; limited real information about the state of internally displaced persons, imperfection of methods and tools for obtaining it, the difficulties of the economic order. The study identifies a number of strategies for social interaction of internally displaced persons in terms of adaptation: the first strategy is characterized by systemic isolation of another’s socio-cultural environment; the second is manifested in the perception and evaluation of life events through the prism of traditions and values of their ethnic group, the third strategy, the so-called strategy of “blind” assimilation, has a feature: denial of their own ethnocultural values and unconditional acceptance of traditions in the territories.

CONCEPTUAL APPROACHES TO THE STUDY OF THE PROBLEM OF NORMATIVITY IN PSYCHOLOGICAL SCIENCE

Anotation. The article deals with the analysis of conceptual approaches to the study of the problem of normativity in Ukrainian and foreign psychological science and the level of research of this problem, in particular, in the aspect of psychological analysis of the normative behaviour of individual. The author also clarifies and further concretizes the conceptual apparatus of the study, which includes definitions of basic categories and concepts of work. The article analyses the nature of congruent relationships between normativity and norm. As the essential attributive characteristics of the norm, meaningfully relevant to the subject of research – normative behaviour, the author identifies: the objectivity of the norm, i.e. its independence from individual consciousness; low level of awareness; the ability to exert a regulatory influence on behaviour; the ability to organize behaviour in a certain direction, i.e. to act as a formative guideline for action; the ability to predict the final result of actions.

THE FOUR-DAY WORKWEEK AS A TOOL FOR OVERCOMING GENDER INEQUALITY IN LABOR

Gender discrimination in any social sphere (both public and private) and in any institution (from family to politics) is an important issue, please in a democratic society should be addressed at the state level. The aim of the article is to explore the experience of the Introduction of a four-day workweek as a tool for the resolution of gender inequality. The article examines the implementation of the four-day workweek in world practice. The analysis uses the experience of Great Britain, the USA, Spain, Japan and New Zealand as pioneer countries in the implementation of the policy of reducing the workweek. Identified the prospects of introducing a four-day workweek for overcoming gender inequality and reducing the gender pay gap. Highlighted the ways and prospects for the implementation of a four-day workweek in Ukraine.

USE OF THE PROPERTIES OF LAW AS A CERTAIN TYPE OF SPEECH AND COMMUNICATION FOR EFFICIENCY OF LEGAL ARGUMENTATION

Anotation. Scientists tried to study legal reality as a functionally oriented sphere of communication from the standpoint of various approaches and methodologies in both the social sciences and the humanities. After all, law as a specific type of communication has many contexts – interpersonal, cultural, political, international, racial, ethnic, organizational, structural, discourse, etc. The purpose of the article is to analyze the law as a certain type of speech and communication, taking into account its argumentative conditioning. Law is demonstrated as a special type of speech and a means of communication with specific characteristics depending on who is the addressee and the addresser. First, law is the result of people's communicative activities; secondly, law is the result and basis of behavior in the socio-cultural space; third, law is a special style of presenting information (as a monologue, dialogue, polylogue, internal speech or subjectless communication); fourth, law is motivational speech (voluptuous, manipulative, and hermeneutic). All these features and properties of law as fully as possible outline the main characteristic of the effectiveness of law in relation to social subjects – functional and communicative argumentation. Depending on the situation and analytical approach, this aspect of legal argumentation is clearly based on communicative technologies of the influence of speech and conscious perception.

THE CONCEPT OF OBJECTIVITY IN CRIMINAL PROCEEDINGS IN THE SCIENTIFIC DISCOURSE OF FOREIGN LAWYERS

Anotation. The article is devoted to the generalization of opinions and positions in modern foreign scientific doctrine on the concept of objectivity in criminal proceedings. It is noted that today objectivity is criticized, but for many lawyers it is still an important value and a necessary condition for making fair procedural decisions. It is concluded that in determining the objectivity/non-objectivity of decisions, it is important to assess the cognitive conditions under which it was made. If the majority of authorized persons, being in such a practical situation, would make the same decision – we can talk about moderate objectivity, which means minimal subjective influence on the decision. The subjective irrationality of a detective, prosecutor, or judge consists of two components: intuitive and emotional. The intuitive component of irrationality is important because it makes the range of judgments and evaluations more plastic. This affects the process of making procedural decisions based on the specific case. Instead, the emotional component of irrationality must be maximally eliminated.
Keywords: The article is devoted to the generalization of opinions and positions in modern foreign scientific doctrine on the concept of objectivity in criminal proceedings. It is noted that today objectivity is criticized, but for many lawyers it is still an important value and a necessary condition for making fair procedural decisions. It is concluded that in determining the objectivity/non-objectivity of decisions, it is important to assess the cognitive conditions under which it was made. If the majority of authorized persons, being in such a practical situation, would make the same decision – we can talk about moderate objectivity, which means minimal subjective influence on the decision. It is established that the principle of efficiency indicates the rational construction of the judiciary, according to which the process should be carried out with minimal time, resources, minimized material and organizational costs, to ensure fair, correct and prompt consideration of administrative cases. The author substantiates that the principle of efficiency requires urgent legal regulation to ensure its effective practical implementation and improve the judicial reform of administrative courts.

PECULIARITIES OF JUDICIAL PROCEEDINGS OF MORTGAGE LEGAL RELATIONS

Anotation. This article considers procedural and legal aspects of the peculiarities of consideration of mortgage legal relations cases during the application of foreclosure on the substance of mortgage given a court decision established by Article 39 Law of Ukraine on Mortgage. Ways to meet mortgagee’s claims when applying for a mortgage based on a court’s decision are: 1) realization of the subject of the mortgage by conducting a public auction (Articles 41–47, Law of Ukraine On Mortgage); 2) sale of the subject of the mortgage by the mortgagee to any person-buyer (Article 38, Law of Ukraine On Mortgage). It is concluded that legislator identified three ways to protect the meeting of the creditor’s claims which are secured through mortgage foreclosure: judicial by court decision and two extrajudicial protecting methods based on executive inscription of notary and according to the agreement on meeting the requirements of the mortgagee.

LEGAL REGULATION OF TEMPORARY ACCESS TO THINGS AND DOCUMENTS

Anotation. The article is devoted to the analysis of one of the relatively new tools of the criminal process - temporary access to things and documents. This legal institution is quite extensive and difficult to apply, which requires further improvement. Temporary access to things and documents in its application has a certain stage, which requires detailed study. The institute of temporary access to things and documents consists of four stages of its implementation. Stages of temporary access to things and documents are characterized by compliance with legal requirements, which are common to all measures of criminal proceedings and are mandatory, as well as compliance with special legal requirements relating only to the institution of temporary access to things and documents. Problematic issues such as the adequacy of data on the person who should provide access to things and documents, the problem of temporal limitation of temporary access to things and documents and its solution are investigated. The procedure of court consideration of a request for temporary access to things and documents depending on the predicted behavior of the person who has the things and documents is analyzed. The requirement to prove the existence of sufficient grounds to believe that there is a real threat of alteration or destruction of things or documents is investigated and our own vision on this issue is offered. The consequences of noncompliance with the decision of the investigating judge on temporary access to things and documents are analyzed.

SPECIFICITY OF THE SUBJECT COMPOSITION OF INHERITANCE LEGAL RELATIONSHIP, THE OBJECT OF WHICH ARE CULTURAL VALUES

Anotation. The article analyzes the specifics of the subjective composition of the hereditary legal relationship, the object of which are cultural values. The positions of scholars on the essence of subjective law in its relation to civil capacity are considered. It is determined that it is necessary to take into account Art. 26 of the Civil Code, part 2 of which states that an individual has all personal non-property rights established by the Constitution of Ukraine and this Code and part 3 of this article, which states that an individual is able to have all property rights established by the CC, other laws. The legal characteristics of the subjects of hereditary legal relations are given. In addition, the peculiarities of the legal status of the testator – a natural person after whose death the inheritance remains – are substantiated. It is concluded that speaking about the subjective composition of the hereditary legal relationship, the object of which are cultural values, among other things, it is necessary to emphasize the diversity of approaches to determining the participants of hereditary relations directly involved in the inheritance of cultural values.

Anotation. Different approaches in the definition of “control” and “supervision” are analyzed, their main characteristics are highlighted and the essence of control and supervision activities in the pre-trial investigation, its purpose and objectives are determined. The features of the implementation of various forms of control and supervision activities in the pretrial investigation and their relationship are revealed. It is proved that control and supervision have a common goal and task ‒ to ensure the legality of pre-trial proceedings, prevention of violations and their elimination, ensuring respect for the rights, freedoms, legitimate interests of individuals. Their difference is in the competence (content of powers) of subjects, methods and forms of the work. Thus, control and supervision activities in pre-trial proceedings have their own independent purpose, and the content of its subjects activities during the discharge of their duties is determined by the subject of supervision and control and the means of their implementation.

ADMINISTRATION OF JUSTICE BY A JURY IN UKRAINE

Anotation. The scientific article considers the theoretical and legal problems of the administration of justice by a jury in Ukraine. Using the historical method of research, the social and legal value of the institute of jury trial is revealed. The social and legal value of the institution of a jury trial is that the administration of justice by a jury is an opportunity to ensure the rule of law in criminal proceedings. The comparative method was used to compare the continental model of jury trial in Ukraine and the English model of jury trial. A system and structural analysis of the norms of the current Criminal Procedure Code of Ukraine regulating the implementation of criminal proceedings by a jury, as well as the norms of draft laws providing for a change in the model of a jury trial in Ukraine. The optimal requirements for a jury trial, which should operate in the modern Ukrainian criminal process, have been determined. Conclusions were made on the need to increase the number of jurors in the jury, to expand the substantive competence of the jury, to delimit the powers of the presiding judge and the jury in the trial.

GROUNDS FOR TERMINATION OF DISTRIBUTING AND BLOCKING PROHIBITED CONTENT BY OPERATIONAL UNITS OF LAW ENFORCEMENT AGENCIES OF UKRAINE

Anotation. Based on the analysis of the current domestic legislation, the article deals with the description of the legal norms concerning the grounds for termination of distributing and blocking prohibited content by operational units of law enforcement agencies of Ukraine. Taking into account that there is no legal norms that allow law enforcement agencies to block any content on the Internet, in particular, in social networks, the author made proposals for using of rules and conditions of social networks to use them to prevent and counteraction to criminal offenses committed in this area. Despite of the spread of Internet using by criminals for illegal purposes, today there is no statutory rights that allow to law enforcement officers effectively prevent the spread of these criminal offenses.

DECENTRALIZATION AS A DRIVING FORCE OF SUSTAINABLE ENVIRONMENTAL POLICY: THE EXPERIENCE OF SWEDEN

Anotation. In recent decades, the topic of implementing sustainable development mechanisms remains relevant. In many European countries, where environmental policy can be considered balanced, local governments have significant environmental powers. This state of affairs is not accidental and is therefore subject to further investigation. One of the best sustainable practices today is in Sweden, so this is what will be discussed in this article. Decentralization reform began in its territory as early as the middle of the twentieth century, and since then municipalities have played a significant role in shaping modern sustainable Sweden. The article presents the numerous practices that Swedish cities have today. And with the help of analytical reflection, comparative and dialectical methods of scientific knowledge it is concluded that the emphasis at the local level on solving various problems, including environmental, has led the country to the results that the country now has and has become a driving force in the formation of Sweden, exemplary for all other countries, balanced environmental relations.

The article examines the prerequisites for the emergence of smart, functioning and differentiating features of smart contracts. The paper presents both the advantages and probable risks of using smart contracts in modern conditions. The article places special emphasis on the functioning of smart contracts from a legal point of view, paying special attention to private international law and their practical applicability in this area.
