METHODS OF TEACHING MODERN RUSSIAN AS A FOREIGN LANGUAGE IN HIGHER SCHOOL

Anotation. In this paper the author examines the general methods of teaching the Russian language in higher education, analyzes the classification of methods for teaching linguistic disciplines in higher education. It proves the effectiveness of the use of various methods and their combinations in the study of Russian as a foreign language in higher education. At the Taras Shevchenko National University of Kyiv groups of foreign students are often formed without regard to nationality, so the teacher must select (combine) methods and techniques for successful learning. The author also considers in detail the application of the design method in a foreign audience, since it allows foreign students to learn through activities. They can independently formulate the problem, collect and analyze the necessary information, draw conclusions and visualize the result of the work done.

PROVISION OF SOCIAL AND PEDAGOGICAL SUPPORT FOR ORPHAN CHILDREN IN A FOSTER FAMILY

Anotation. The author notes the importance of preparation of orphans for living in a foster family. It is noted that the program of support for orphans can serve as a model of comprehensive socio-pedagogical support for orphans. The tasks on which the program should be focused are specified. The list of subjects of pedagogical support of socialization of orphans in the conditions of a foster family is defined. The important role of involving orphans in various interpersonal interactions with various social institutions is noted. The content of the theoretical model of the technology of pedagogical support of orphans in the foster family through the prism of such factors as conditions, principles, participants, forms of implementation, methods, is presented. Emphasis is placed on the model of psychological and pedagogical support for the preparation of orphans for transfer to the family, which outlines the activities, actions, forms of work, methods, techniques and people, responsible for each specific area. Features of social and pedagogical support and mesoand micro-levels are noted. The socio-pedagogical direction of activity in the context of interaction of the foster family with the network of institutions of social education is considered. The key principle of the program and the importance of the role of curators and tutors are considered. The priority directions and features of interaction of the curator and the orphan are outlined. It is indicated that for the implementation of full socio-pedagogical support for orphans it is necessary to combine individual and group forms of work, such as correctional classes, work in communication groups and methodological groups, measures to improve the pedagogical competence of foster parents. It is emphasized that the possibility of interaction of social workers with future foster parents significantly increases the level of efficiency of work with the foster family.

PEDAGOGICAL MEASUREMENT OF THE PSYCHOPHYSIOLOGICAL COMPONENT OF THE PROFESSIONAL READINESS FOR COMBAT FLIGHTS OF FUTURE TACTICAL PILOTS

Anotation. The article presents and substantiates the results of pedagogical measurement of psychophysiological component of professional readiness of future pilots of tactical aviation in the conditions of educational process of aviation higher military educational institution (the only one in Ukraine – Ivan Kozhedub Kharkiv National University of Air Forces). In the framework of the author's concept of professional readiness of military pilots-cadets, this component is also considered as a relevant criterion. Our variant of the specified pedagogical measurement is based on the actually developed set of indicators and levels of estimation of the given criterion on the one hand and the method of scaled self-assessment (on visual-analog scales) of A. M. Kokun as a methodological tool from another. Anotation. The article considers the main methodological approaches in the preparation of future physical education teachers for sports and patriotic activities in general secondary education. We have proposed the following methodological approaches: axiological, creative, sociocultural, interdisciplinary and system and activity. The axiological approach promotes the development of the axiological characteristics in patriots. The creative approach will help with creative work of sports and patriotic nature in applicants for general secondary education. The sociocultural approach will attach great importance to tolerance and humanism in interpersonal relationships and develop respect for other cultures. The interdisciplinary approach will outline a certain line of patriotic training, covering most of the educational components. The system and activity approach is applied based on the cultural heritage of Ukraine, its connection with the European cultural space, the enrichment of culture with best practices of the world heritage. The research will promote the implementation of national and patriotic, military and patriotic as well as sports and patriotic education in general secondary education by physical education teachers.

PEDAGOGICAL CONDITIONS OF FORMATION OF FUTURE LAWYERS’ READINESS FOR PROFESSIONAL FOREIGN LANGUAGE COMMUNICATION

Anotation. The article is devoted to the problem of preparing specialists in the field of law for foreign language communication within the profession, which is one of the main tasks currently facing the system of higher legal education. Its purpose is to highlight the pedagogical conditions for implementing the technology of formation of the readiness of future bachelors of law (LLBs) for foreign language professionally oriented communication. As a result of the study, basic pedagogical conditions vital for implementation of pedagogical technology aimed at developing future lawyers’ foreign language competence have been identified and substantiated. They are as follows: readiness of a foreign language teacher in the field of law to form LLBs’ foreign language communicative competence, focus on law students’ individual psychological characteristics, in particular their educational and cognitive styles, creation of an open foreign language communicative environment by engaging modern information and communication technologies.

A STUDY OF TRANSLATION TEACHING MODEL BASED ON WORKPLACE LEARNING IN ARTIFICIAL INTELLIGENCE ERA

Anotation. This article aims to explore and develop a translation workshop teaching model on the basis of the smart translation teaching ecosystem after the changes in the new era, compared with the traditional model of translation teaching and learning, and discuss the application of this model into the translation teaching practices, with the aid of the computerassisted translation and other translation technologies, so as to enhance the translation learners’ competence. The author has carried out an experiment for one semester to verify the feasibility of this new model with pre-test, post-test, interview and questionnaire survey on the experimental students. Through the analysis of comparisons on the collected data, the results show that this new model has improved the effectiveness of teaching, promoted the learners’ translation competence in translation skills, fidelity and fluency, accuracy of language use, and creativity. The new mode of translation teaching has won the students’ recognition. This research has further implications for improving students’ translation theoretical knowledge and skills and teachers’ knowledge structure as well.

CULTURAL DISCOURSE AS A FACTOR OF CONNOTATIVE COMMUNICATION OF MARGINAL PERSONALITY: PHRASEOLOGICAL SEMANTICS

Anotation. In the reseach main attention is paid to the problem of studying the semantics of phraseological units of sociopolitical discourse as an effective factor in the manifestation of the communication process in the context of the specifics of the speech activity of politicians aimed at creating a negative image of opponents. Two conditional functional groups of phraseologized statements on creation of a negative image of the political opponent are allocated: a) intent to commit a speech act of harsh condemnation; b) the intention of committing a speech act of veiled sharp ridicule.

MUSICAL WORKS OF EUROPEAN AUTHORS IN THE VOCAL REPERTOIRE OF CHILDREN (ON THE EXAMPLE OF PARTICIPANTS OF THE FIRST SEASON OF THE SHOW “THE VOICE. KIDS” – UKRAINE)

Anotation. The article considers the issue of repertoire preferences of the modern younger generation. Peculiarities of vocal repertoire selection for children’s participation in various festivals, competitions and TV shows are analyzed. The research methodology is systematization of theoretical data, application of methods of analysis and synthesis, objective observation, comparison and content analysis. In particular, the analysis of the repertoire component of the first season of the show “The Voice. Kids” and summarized statistical data, which show the tendency of children to perform vocal works by European authors and a high level of interest in European musical culture. According to our research, among European vocal works, the most performed among children are highly artistic compositions that promote the vocal abilities of young vocal artists and shape their artistic taste. Such musical works are a heritage of world musical culture, do not lose their relevance for many years and are valuable landmarks for imitation and improvement of performing skills.

ROBERT DICK – REVOLUTIONARY COMPOSER AND FLUTIST OF THE FUTURE

Anotation. The work is devoted to the study of the creative path of the modern revolutionary composer-performer Robert Dick. The article reveals the features of the composer’s style, performance, theoretical and pedagogical activities of a modern musician. The research methodology is the application of the general scientific principle of objectivity, biographical, systematic, analytical, stylistic, historical and typological methods in the study of biographical data of Robert Dick, features of the creative heritage of the composer-revolutionary, bright flutist of the XXI century. Robert Dick is rightly considered an innovator in the art of flute, the author of important works in flute pedagogy of the twentieth century. “The Other Flute” is considered the main methodical book in modern flute performance. As a popular flute player, Robert Dick is fluent in a variety of music genres, including classical, jazz, rock, electronic, and world music. Its performance is full of modern techniques. The avant-garde flutist, inventor of the Glissando Headjoint is not considered a pioneer of non-standard techniques, but his model of application and notation of advanced techniques are convincingly and practically demonstrated to a wide range of flutists. In more than two hundred works, the composer demonstrates the ability of the flute to perform various musical roles in any genre.

UNIVERSITY EPISYSTEM AS THE BASIS OF THE INTELLECTUAL CULTURE OF THE MODERN UKRAINIAN NATION FORMATION

Anotation. The article reveals the spiritual features of national traditions in the national university education system in its historical and socio-cultural ties. The main focus is on the dialogic nature idea of the Ukrainian education model and socio-cultural foundations of national scientific experience, built on both European standards of education and ethnic and cultural archetypes in its composition. Entry of national culture into the European cultural and educational process in the XIX century brought to life the idea of human formation that combines bright individual qualities, high patriotic feelings, civic consciousness, patriotism, personalism. The reminiscence of the ancient heritage gave an impetus to the integration of the innovative Western European intention of the scientific worldview with the conservatism of the Byzantine form of spiritual development. A brilliant constellation of scientists, writers, philosophers, artists, statesmen, and hierarchs was formed on these two foundations of the common heritage. They formed the Ukrainian elite with a thorough knowledge of native and world literature, history, foreign languages, philosophy, mathematics, legal theories, art, which in modern conditions serve to train European-style professionals.

Consideration of the phenomenon of the Transcarpathian theatrically-scenery art is really a maiden attempt to carry out generalization and enter this concept to scientific turnover, exposing him genesis and connection with artisticallycultural processes on Transcarpathia, by new conceptions of modern visual art.

JOHANN WOLFGANG VON GOETHE’S SCIENTIFIC ACTIVITY IN THE CONTEXT OF RETHINKING THE PLASTICITY OF FORM IN THE XIX CENTURY

Anotation. The article examines in detail the scientific work of Johann Wolfgang von Goethe in the field of plastic anatomy and its significance for art education in the nineteenth century. This aimed to address pressing issues of a new approach to the study of anatomy and a new understanding of the plasticity of the shape of the human body in the fine arts of the XIX century. The study of plastic anatomy Goethe considered a necessary condition for the training of medical and artistic specialties, and considered it necessary to create wax anatomical plastics, which were used as a methodological material in the training of both physicians and artists. The author examines in detail the genealogy of Goethe’s views on the problems of realism in the fine arts and their impact on the intellectual and creative circles of contemporary Europe. Despite all the scientific achievements, so far Ukrainian art criticism has not paid due attention to the study of this issue.

SHI GUANGNAN “REGRET FOR THE PAST” IN THE SPACE OF MODERN CHINESE THEATER: RELEVANT ASPECTS OF INTERPRETATION

Anotation. The article outlines the ways of formation of Chinese opera of European type and highlights the main stages of mastering the European tradition in the field of theatrical art. The opera culture of modern China is considered as a holistic phenomenon with a complex structure and style diversity. Shi Guangnan’s “Regret for the Past” performances in 1981 (Beijing People’s Theater) and 2018 (Poly Theatre, Beijing) explored the forms of gaining European experience in modern Chinese opera.

Anotation. The paper focuses on the ethnolinguistic study of the literary character in English Amerindian prosaic texts. Ethnolinguistic perspective of the present work foresees the highlighting of such aspects of the contemporary linguistics of the literary text as the narrator of the literary text, ethnocultural ornamentalism of the literary text and the lingual means of the literary character of the narrator as the narrator-ornamentalism formation and realization in the ethnocultural ornamentalism in the canvas of the literary text. The work has given the results of the textual and interpretative analysis of the modern English Amerindian prosaic texts in ethnolinguistic perspective. In this work the narrator tells about the worldview, ethnocultural values, ethnorealities and the perception of that by contemporary American people who have Indian roots. The paper reveals the dominant ethnocultural concepts (HARMONY, BALANCE, UNITY, MEMORY, SACRALITY OF NATURE AND THINGS), lexical and stylistic means of their actualization (repetitions, personification, metaphorization, metonimization) in the narratives and their cultural meaning for American people nowadays.

COMMON MODELS OF SHORTENINGS IN ENGLISH MEDIA TEXTS ABOUT MUSIC (BASED ON INSTAGRAM MESSAGES)

Anotation. The research is dedicated to the analysis of English shortenings in compressed media texts on music (based on Instagram messages) in order to explore their typology, formation models, as well as to identify their most common types. The relevance of the work is determined by the active tendency to language compression when communicating on social media pages, which contributes to the emergence of new abbreviations in English, the understanding of which is difficult for comprehension of the messages content itself. In the course of work with the help of the empirical method, the method of continuous sampling, comparative method, etc. the main ways of forming abbreviations in English were studied; a selection of media texts containing abbreviations was made on the pages of musicians from the Instagram social network; the reduction of language units by structural types, frequency of use and lexical affiliation was analyzed.

The image of “water” is an ancient universal symbol of all cultures of the world, as it is associated with the primordial matter and birth, as a result of which water is considered as the guardian of life, symbolizes its beginning and end. Fire is most often seen as a male substance and as a symbol of vital energy, the heart, the fertilizing force, enlightenment, the Sun. The image of “water” is not a holistic image, it consists of many forms: sea, river, ocean, lake, dew, stream, rain, downpour, thunderstorm, storm, ice, fog, well, spring. The image of “fire” is also objectified by different forms: a hearth, a candle, a flame, a bonfire. SUBJECT AND SUBJECTIVE IN THE UKRAINIAN SHORT STORY OF THE END OF XIXTH – THE BEGINNING OF XXTH CENTURIES: METAPHYSICAL DISCOURSE

Anotation. The characteristic features of Ukrainian literary process at the end of XIXth – the beginning of XXth centuries develops in connection with Modernism. Ukrainian writers reflected the realities of human life and psychological states, feelings of the characters. Writers’ worldview was formed in the cultural context and philosophy of that time. Therefore, the article deals with the subject and subjective in the Ukrainian short story of the end of XIXth – the beginning of XXth centuries. The subject and the subjective in the Ukrainian short story are manifested both at the level of poetics and in the philosophical-aesthetic, metaphysical discourse. These categories are actualized the ontological markers of the human being, the relationship of the author’s personal life with the world and thus reveal the metaphysical discourse of the Ukrainian short story. Author’s subjective perception of the world is most evident in autobiographical works. In the short stories “Moye slovo”, “Doroha” (“My Word”, “The Way”) by Vasyl’ Stefanyk, “Karby” (“Notches”) by Marko Cheremshyna, “Intermezzo” by Mykhailo Kotsyubynskiy, the subjective becomes the basis for the author’s transcendence, Art. The subjective is manifested through author’s personal reflections, the projection of his own subjective world. It was founded out that in short stories the subject and the subjective emphasize the relationship between «I» and “Other”. UKRAINIAN-POLISH LINGUISTIC CONTACTS IN THE 16TH – 17TH CENTURIES: LEXICAL LEVEL

Anotation. The Article deals with the peculiarities of the Ukrainian and Polish linguistic relations. The Article provides insight into the historical and social preconditions of the reinforcement of the interlinguistic contacts during the late Middle Ages. Under the conditions of the intensification of the literary communication, the research material is represented by the 17th century Drama “Oleksii, a Man of God” as a text representing the literary legacy of the Ukrainian Baroque demonstrating the peculiarities of the communicative process of those times. The borrowings found in the text are combined into the lexical and thematic groups with the indication of their origin. The conclusion is drawn concerning the extension of the lexical composition of the Ancient Ukrainian language due to the Polonisms because of the process of approximation of the Ancient Ukrainian words to the semantic structure of the same Polish lexemes. It is determined that due to the mediation between the Polish Language and the Ancient Ukrainian the borrowings from the other European languages, in particular, Germanisms and Latinisms actively penetrated as well. The perspectives of further studies are substantiated considering the description of the model of the semantic adaptation of the Polish borrowings to the system of the Ancient Ukrainian language and their further functioning in the modern Ukrainian Language.

Anotation. The article has a meta-anthropological explanation of the phenomenon of happiness in the existential views of the human butt. Anthropology as meta-anthropology in sociohumanitarian knowledge reveals the existential dimensions and presents different paths to happiness. The phenomenon of happiness can be understood as a movement from оrdinary being of man existence to the ultimate being of man and transcendental being of man. Each dimension has its own manifestation of happiness. Оrdinary being of man existence as a material taste. Ultimate being of man being strives for freedom, creativity. To feel happiness in full is possible only in transcendental being of man, where a person is focused on freedom, love and co-creation. The authors suggest a way to reach the highest existential dimension. To feel the happiness in full volume, it is necessary to reach meta-borderline existence.

PECULIARITIES OF ADAPTATION OF THE UKRAINIAN VERSION OF THE FEAR OF CANCER RECURRENCE INVENTORY

Anotation. The article presents the results of the first stage of adaptation and validation of the Ukrainian version of the Fear of Cancer Recurrence Inventory, which is a world-renowned method of detecting clinical levels of fear of cancer recurrence in cancer survivors. Statistical processing of the test results of the questionnaire was carried out, the obtained data were analyzed in order to make the necessary adjustments. Additionally, the identified patterns of responses of Ukrainian cancer survivors are considered. Objective: to adapt the Fear of Cancer Recurrence Inventory into ukrainian for use in psychooncological practice. Methods: testing of the Questionnaire by 50 cancer survivors women. Statistical analysis of test data using IBM SPSS, analysis of the results. Results: the first stage of adaptation of the Fear of cancer recurrence inventory (FCRI) proved that the Ukrainian version is ready for further validation. Conclusions: The existing version of the questionnaire passed the test of the first stage. The prospect of further research is to test the Questionnaire on a wide sample of cancer survivors and to start a practical application of validated methods in Ukrainian cancer survivors to study their inherent psycho-emotional state on this issue.

Anotation. The article seeks to identify the position of the referendum in the system of direct democracy forms. The study findings support the idea that the institutions of direct democracy in all countries of the world are the most accessible forms in solving significant political issues. The issue of the place and role of referendums in the political life of society has been the subject of many scientific studies. Scientific interest in the problems of the nature and role of referendums has always existed due to the interdisciplinary nature of this phenomenon, as the research on referendums and other forms of democracy has long been a subject area of constitutional law theory and only recently has become the subject of political science and sociology. The etymology of the concept and types of referendums are the focus of the study. The author analyzes the stages of referendums, the peculiarities of referendums in Switzerland and other European countries, as compared to the subject of a referendum in Ukraine, substantiates the place and role of the referendum in the modern democratic society system. In a democratic society, the Referendum plays a significant or even dominant role. It directly influences the political situation in a country, nullifying/overturning decisions of government and parliament.

THE IMPACT OF DIGITALIZATION ON THE UKRAINIAN CIVIL SERVICE DEVELOPMENT

Anotation. Decentralization of power has become a real ambassador among the reforms that have been implemented in Ukraine over the last decade. And it’s not just about its scale and the serious qualitative changes that followed. After all, it is the decency, efficiency and municipal responsibility of bodies and officials of local self-government that guarantee the successful development of the territorial community. And first of all, it concerns deputies of local councils who are direct representatives of interests of inhabitants of the community. The article theoretically substantiates the need to identify ways to improve the efficiency of local councils and use the recommendations in the process of further implementation of the decentralization reform. As a result, it was found that among the key ways to improve the quality of local council deputies are: – advanced training and self-education; – established communication between officials, the community, bodies of self-organization of the population and bodies of local self-government; – appropriate legislative support and expansion of guarantees of deputy activity; – cooperation with mass media and leaders of public opinion; – clear and regulated procedure for early termination of powers.

Anotation. Logistic processes can be modeled, analyzed, visualized and optimized using special modeling software. Minimizing resource use is a common motivation in logistics for imports and exports. The purpose of this study is to identify the place of logistics controlling in the management system of enterprise efficiency. The research methods such as analysis, synthesis, description, bibliographic analysis and comparison are used in the work. Globalization of logistics is an integral part of such processes taking place in all spheres of the world economy. This process has not left the company unattended, but to enter the international arena with outdated methods, ideas and ways of conducting logistics operations – means dooming yourself to failure. Therefore, it is necessary to use modern technologies and innovations, which are resorted to by developed countries that actively use the achievements of the scientific and technological revolution, which is based on computer technology. The correct structure and use of logistics systems, based on the introduction of integrated logistics activities of international standards – is success in international markets and integration into the modern structure of foreign economic relations.

ISSUES OF LEGAL REGULATION OF THE ACTIVITIES OF THE PROSECUTOR’S OFFICE OF THE RUSSIAN EMPIRE THAT AROSE DURING THE PREPARATION OF THE JUDICIAL REFORM OF 1864

Anotation. The article deals with the issues of legal regulation of the activities of the Prosecutor's Office of the Russian Empire, which arose during the preparation of the judicial reform of 1864. It is concluded that with the gradual change in the concept of the future criminal process (the transition from the investigative to the investigative-accusatory process), views on the role of the prosecutor in it also gradually changed. The initial proposals only for some extension of his rights were later replaced by proposals to fundamentally reform the legal status of the prosecutor and provide him with the function of prosecution. In the process of preparing the reform, Western European scientific theories, legislation and practice of its application were taken into account. However, there was no mechanical borrowing. Foreign experience was taken into account with an adjustment to the local conditions of the Russian Empire, and many of the provisions on the prosecutor’s office adopted by the legislator had no analogues in foreign legislation and were more progressive.

IMPLEMENTATION OF THE CONSTITUTIONAL RIGHT TO PEACEFUL ASSEMBLY AS AN OBJECT OF ADMINISTRATIVE AND LEGAL REGULATION

Anotation. The article is devoted to the formation of an up-to-date scientific opinion on the implementation of the right to peaceful assembly in Ukraine as an object of Administrative and Legal Regulation. The system of grounds (normative, factual, and procedural), as well as the main conditions (the presence of positive circumstances, the absence of negative circumstances of reality that limit or exclude legal realization) for the implementation of the relevant constitutional right, is comprehensively clarified. Based on a critical analysis of the grounds and conditions for the realization of the constitutional right to peaceful assembly, the author justifies the position that this realization is subject to administrative and legal regulation. This position is approved by the next arguments: 1) although Art. 39 of the Constitution of Ukraine remains the main guideline of the breadth of freedom of peaceful assembly (and the exercise of the right to peaceful assembly), the realization of the relevant right is mainly regulated by the norms of administrative (substantive and procedural) legislation; 2) the normative basis for the realization of the right to peaceful assembly in Ukraine is the norms in which the state is entrusted with the duties to ensure the implementation of such a constitutional right, as well as to ensure the proper functioning of the regime of Public Security and order during peaceful assemblies.

FEATURES OF FORENSIC EXAMINATIONS DURING THE INVESTIGATION OF CRIMINAL OFFENSES COMMITTED BY ARSON

Anotation. The purpose of the article is to reveal the purpose, tasks of forensic examination in the investigation of criminal offenses committed by arson, the peculiarities of solving current practical problems under these conditions. In criminal proceedings for criminal offenses committed by arson, the expert’s opinion is an important source of evidence. Promising areas for the development of forensic science in criminal proceedings for criminal offenses committed by arson include: study of patterns of formation and development of registered types of forensic science, expanding their capabilities; strengthening the basis of the theory of forensic science; development and improvement of means, methods and techniques of expert activity; development of software for forensic examinations; forecasting of the processes occurring in expert practical activity and tasks of scientific researches in the field of forensic examination. Particular attention should be paid to the collection of materials – physical evidence to ensure the process of forensic examinations. The prerequisite is a quality and effective inspection of the scene and other investigative (search) actions.

Anotation. The article is devoted to the possibility of providing psychotherapeutic assistance to victims of juveniles in criminal proceedings. It was emphasised on the vulnerability of the child's psyche and increased caution during the interrogation of a minor victim. Age periods of “turbulence” crises are studied. The authors analyze the key principles of palliative care. A new vision of interrogation through palliative care is proposed. The possibility to avoid establishing during interrogation the reasons and conditions that contributed to the commission of a crime against a minor directly through the interrogation of the victim child, is considered.

The article considers the problematic issues of distinguishing between lawful and illegal use of a trademark on the Internet, namely: imperfection of civil law and legislation in the field of intellectual property; ambiguity and complexity of judicial practice in this category of cases. Also, the doctrinal researches of scientists on the use of the trademark in the technical part of the website in the meta tags <title>, <keywords>, <description> and the researches in which the concepts and forms of guilt in civil law are analyzed are considered. In addition, the above scientific measures within the study allowed to simulate the controversial situation of trademark use in the technical part of the website and give it a reasonable legal assessment based on the provisions of current legislation of Ukraine and theoretical concepts.

It is determined that the administrative and legal status of the Department for the Protection of the Interests of Society and the State, as a separate unit of the National Police, also consists of three blocks: target, organizational and managerial and functional and competence. The purpose of the target bloc stems from the goal of creating a Department for the Protection of the Interests of Society and the State, which can be described as: ensuring public order and security; protection of the rights, freedoms and legitimate interests of citizens and public figures. Organizational block of the administrative and legal status of the Department for the Protection of the Interests of Society and the State, which characterizes how the internal structure of this body is built. It should be noted that general information about the structure, number of staff, tasks and functions of the Department for the Protection of the Interests of Society and the State is official information that is not publicly disclosed. The organizational structure and staff of the Department for the Protection of the Interests of Society and the State shall be approved in accordance with the procedure established by the legislation of Ukraine.

CHALLENGING ISSUES IN THE APPLICATION OF PART 3 OF ARTICLE 13 OF THE CIVIL CODE OF UKRAINE IN RESOLVING DISPUTES ABOUT THE ABUSE OF CIVIL RIGHTS

Anotation. The article analyzes the provision of Part 3 of Art. 13 of the Civil Code of Ukraine, which prohibits any person from abusing his civil rights. It is considered authors’ researches on the definition of the category of “abuse of rights” and the identification of typical features of such a phenomenon as the abuse of rights. The content of the rule enshrined in Part 3 of Art. 13 of the CC of Ukraine is covered, and the statutory features of such a phenomenon as abuse of rights are specified. The author compares the available statutory regulation of the institute of “abuse of rights” and relevant theoretical developments in terms of identifying mandatory features inherent in the specific legal category. It is concluded that the first and main feature necessary for the qualification of a person’s actions as an abuse of rights is the person’s subjective right. The research highlights that it is necessary to study the practice of applying the rules of Part 3 of Art. 13 of the CC of Ukraine in order to identify vulnerabilities in law enforcement and improve the current regulations.

The purpose of the article is to define the essence of the concept of “forms of administrative supervision implemented by the National Police”, the classification of their species, and the characteristics of the content. The article examines the essence of the category of “forms of administrative supervision implemented by the National Police”. It is determined that it is due to the forms that the functions and tasks of the police in the field of general administrative supervision defined at the level of legislation are implemented. Proper use of these forms directly affects the results of administrative and supervisory activities and the effectiveness of the National Police as a whole. The classification of the applied forms is carried out and their characteristic is carried out. It is concluded that the forms of administrative supervision of the National Police are the external expression of a wide range of purposeful, different in content and essence of actions and measures implemented within the functional powers of police bodies and officers in the direction and to ensure public order, law and order in public relations, observance of guaranteed rights and freedoms of their participants.

The author, using an activity approach to understanding a phenomenon or process, proposes to include in the system of public governance of gambling the following elements: subjects of governance, objects of governance, purpose and objectives of public governance, functions of public governance and mechanism of public governance of gambling, legal responsibility. In turn, the mechanism of public governance of the gambling business includes forms, methods and means of public governance. Discussions on the inclusion of legal liability in public governance have been going on for a long time. Within the system of public governance of the gambling business, the author proposes to consider only the counteraction to offenses that affect the state-defined state of the model of public governance of the gambling business.
